Important Notice Regarding Social Media Screening by DHS
The U.S. Department of Homeland Security (DHS) has announced that it will begin screening the social media activity of individuals applying for U.S. immigration benefits. This includes monitoring for any content related to antisemitism. We strongly advise all students to ensure their online presence complies with applicable community standards.
For further details, please refer to the official announcement from USCIS here.
At Bay Atlantic University, we are committed to supporting our international students as they navigate the rules and regulations that govern their student visa status. Compliance with U.S. immigration laws is critical to maintaining your ability to study, live, and work in the United States. Students are required and expected to focus on their academic progress and strictly adhere to the terms of their visa and immigration status at all times.
Understanding Visa Revocations and SEVIS Record Terminations
Recently, there have been reports of F-1 visa revocations and SEVIS (Student and Exchange Visitor Information System) record terminations affecting international students at institutions across the United States.
It is important to understand that while affected students may not be immediately removed from the United States, their F-1 status is considered invalid following a visa revocation and/or SEVIS termination. Students in this situation are generally required to either depart the U.S. or take corrective action to regain lawful status, if eligible.
We strongly encourage any student who receives a notification of visa revocation or SEVIS termination to immediately contact their Designated School Official (DSO) / Student Services Department for guidance. Our team is here to assist and provide the necessary support while ensuring compliance with all U.S. immigration regulations.
What is a SEVIS Record Termination?
SEVIS is a government system used to monitor international students and exchange visitors. A termination of your SEVIS record means you are no longer maintaining your visa status. This can result from various violations, such as failure to enroll full-time, unauthorized employment, or other breaches of visa conditions.
If your SEVIS record is terminated:
- You lose all employment authorization (including CPT/OPT).
- You cannot re-enter the U.S. on the terminated record.
- You may be required to depart the U.S. immediately.
Common Reasons for SEVIS Record Termination:
- Failure to Enroll: Not maintaining a full course load without prior approval.
- Unauthorized Employment: Working without proper authorization from your DSO or USCIS.
- Criminal Activity: Arrests, such as for driving under the influence (DUI), can lead to visa revocation and termination.
- Policy Violations: Involvement in certain activities or associations under federal scrutiny may result in visa issues. Always consult your DSO if unsure.
Frequently Asked Questions (FAQs):
What is a SEVIS record?
Your SEVIS record is the official record of your student status, maintained by your DSO and monitored by the U.S. government.
What is a visa revocation?
Visa revocation means the U.S. Department of State has canceled your visa. This prevents re-entry into the U.S. even if you are currently still here.
What does it mean if my SEVIS record is terminated?
A terminated SEVIS record means your student status is no longer valid, typically due to violations such as failing to maintain enrollment or visa conditions.
How will I know if my visa is revoked, or SEVIS record is terminated?
Notifications may come from:
- The U.S. Department of State (email – check spam/junk folders too)
- BAU Student Services Office
- Your DSO directly
What Should I Do If My Visa Is Revoked or SEVIS Record Terminated?
- Contact Your Designated School Official (DSO) While we may not immediately know the reason for the revocation, we should be able to provide confirmation.
- Seek Legal Counsel immediately. The DSO office may be able to provide confirmation of an issue, but we are not able to provide legal advice of any kind. You are strongly advised to consult with an immigration attorney experienced in student visa matters.
- Cease Unauthorized Activities: Stop any activities that could further jeopardize your status.
- Prepare for Possible Departure: Understand that you may be required to leave the U.S. immediately after a status violation.
If you have any questions or concerns, please contact the DSO at [email protected] or contact us in Student Services on the seventh floor.
Can I stay or return to the U.S. after termination?
Generally no. A terminated record ends your lawful status immediately, and a terminated visa is invalid for re-entry. Speak with your DSO and immigration counsel promptly.
Can my visa or SEVIS record be reinstated?
Possibly.
- Reinstatement: If eligible, BAU can assist you in filing a reinstatement request to USCIS.
- New I-20: Alternatively, you may need to depart and apply for a new visa with a new SEVIS record.
Each case is different, so always speak with your DSO and legal counsel before taking action.
Can I continue studying or working (CPT/OPT)?
No. Federal regulations prohibit continued study or employment after SEVIS termination.
(8 CFR 214.2(f)(5)(iv))
(8 CFR 274a.12(b)(6))
Students on CPT, OPT, or STEM OPT must stop working immediately. J-1 students also lose Academic Training eligibility.
Next Steps for All Students
As an F-1 or J-1 student at BAU, you are here for the purpose of study. You must:
- Maintain good academic standing. Poor academic performance, attendance violations, or disciplinary issues can jeopardize your visa status.
- Follow all U.S. laws. Even minor infractions may now carry significant immigration consequences.
- Be mindful of your digital footprint, public affiliations, and involvement in non-academic activities or organizations to ensure compliance with institutional and legal standards.
- Avoid underage drinking and public intoxication. The U.S. legal drinking age is 21.
- Do Not get trespass.
- Obey all traffic laws and avoid criminal citations, including trespassing.
- Be mindful of your environment. Choose friends, activities, and events carefully.
- Maintain good financial standing. Unpaid debts leading to court actions may negatively impact your immigration status.
! Remember: Ultimately, the responsibility to maintain your status is yours.
